SERVICE AGREEMENT

Your Acceptance of Our Terms Through The Use of Our Website

By using our website, you (“User”) signify your agreement to this service agreement. Submission of your account order shall constitute your complete acceptance of this Service Agreement.

Please check this Service Agreement periodically for changes as RealtorLeads.net reserves the right to revise this Service Agreement and your continued use of this site following the posting of any changes to the Service Agreement constitutes acceptance of such changes. RealtorLeads.net reserves the right to terminate a User’s use of this site at any time without notice and may do so for any breach of this Service Agreement or the instructions on this site by User. This Service Agreement applies to licensors and advertisers as well.

You Must be Over 18 to Agree to This Service Agreement and Use This Site

RealtorLeads.net cannot accept service agreements and payments from persons under the age of 18 years. As such, Client must be over the age of 18 years.

Proprietary Rights:

Client acknowledges and agrees that content available from RealtorLeads.net or the Service, including but not limited to text, software, music, sound, logos, trademarks, service marks, photographs, graphics, or video, is protected by copyright, trademark, patent, or other proprietary rights and laws. Client shall have no ownership rights to any of RealtorLeads.net’s intellectual property including, but not limited to, common designs, layouts, content, program code, scripts, database structures, proprietary strategies and processes. Client recognizes that RealtorLeads.net may, for illustrative purposes, showcase the work RealtorLeads.net has performed for and on behalf of Client pursuant to the terms of this agreement.. Client shall not attempt to gain unauthorized access to any servers controlled by RealtorLeads.net.

Disclaimer of Warranties

RealtorLeads.net, its advertisers and licensors make no representations or warranties about this site, the suitability of the information contained on or received through use of this site, or any services or products received through this site. All information and use of this site are provided “as is” without warranty of any kind. RealtorLeads.net, advertisers and/or its licensors hereby disclaim all warranties with regard to this site, the information contained on or received through use of this site and any services or products received through this site, including all express, statutory, and implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if RealtorLeads.net, advertisers and/or its licensors have been advised of the possibility of such damage. Indemnification

You agree to defend, indemnify, and hold harmless RealtorLeads.net, its advertisers, licensors, subsidiaries and other affiliated companies, and their employees, contractors, officers, agents and directors from all liabilities, claims, and expenses, including attorney’s fees, that arise from your use of this site, or any services, information or products from this site, or any violation of this Agreement. RealtorLeads.net reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you shall cooperate with RealtorLeads.net in asserting any available defenses.

Limited Liability:

Client expressly agrees that use of RealtorLeads.net’s equipment is at Client’s sole risk. Neither RealtorLeads.net, its employees, affiliates, agents, third party information providers, resellers or the like, warrant that RealtorLeads.net’s service will not be interrupted or error free; nor do they make any warranty as to the results that may be obtained from the use of the service or as to the accuracy, reliability or content of any information service or merchandise contained in or provided through RealtorLeads.net, unless otherwise expressly stated in this Agreement.

Under no circumstances, including negligence, shall RealtorLeads.net, its offices, agents or anyone else involved in creating, producing or distributing RealtorLeads.net’s service be liable for any direct, indirect, incidental, special or consequential damages that result from the use of or inability to use of RealtorLeads.net’s service; or that results from mistakes, omissions, interruptions, deletion of files, errors, defects, delays in operation, or transmission or any failure of performance, whether or not limited to acts of God, communication failure, theft, destruction or unauthorized access to RealtorLeads.net’s records, programs or services. Client hereby acknowledges that this paragraph shall apply to all content on RealtorLeads.net’s Server service.

Notwithstanding the above, Client’s exclusive remedies for all damages, losses and causes of actions whether in contract, tort including negligence or otherwise, shall not exceed the aggregate dollar amount which Client paid during the term of this Agreement and any reasonable attorney’s fee and court costs.

No Resale of Service

You agree not to reproduce, duplicate, copy, sell, trade, resell or exploit for any commercial purposes, any portion of the Service, use of the Service, or access to the Service.

Backup of Data

RealtorLeads.net creates backups nightly. No guarantees are made of any kind, either expressed or implied, as to the integrity of these backups. We strongly recommend that customers of the RealtorLeads.net create a backup of their email leads. Server backups are made for server restoration purposes only. It is the client’s responsibility to maintain local copies of their email leads. If loss of data occurs due to an error of RealtorLeads.net, we will attempt to recover the data for no charge to the client. If data loss occurs due to negligence of client in securing their account or by an action of the client, RealtorLeads.net will attempt to recover the data from the most recent archive for a $10.00 fee. Although we give every attempt to recover a backup should it be necessary, we make no guarantee as to the quality or the results of any recovery attempt.

Description of Service

RealtorLeads.net creates, develops and host lead generating websites on the Internet and may provide Client with, among other things, access to leads generated from ‘Realtor Leads System’. All websites, domain names, text, graphics and hosting always remains property of RealtorLeads.net. All paid services of RealtorLeads.net, including the ‘Realtor Leads System’, are considered to be leased services.

Client Billing

Client’s subscription begins within 24 hours of initial order. When the Client chooses Annual plan, then one year of service is due upon initial order. Client authorizes RealtorLeads.net to automatically charge Client’s credit card for all annually recurring Services. Recurring Services are to paid in advance and will automatically renew for additional periods, each of equal length, unless Client notifies RealtorLeads.net of your intent not to renew the services at least five (5) business day prior to the expiration of the then current term. From time to time, RealtorLeads.net may change the pricing recurring services at any time with 30 days notice. Client agrees to be bound by the new pricing upon renewal of any annual services after the 30 day notice period.

Client must provide RealtorLeads.net with a valid credit card to activate account. Client authorizes RealtorLeads.net to automatically charge his/her credit card for all Services request. Client agrees to keep credit card information updated, and to provide RealtorLeads.net with a new valid account number if the credit card on record fails to process appropriately. RealtorLeads.net may assess a service charge of 1.5 % per month on all unpaid balances. RealtorLeads.net reserves the right to place an account on hold, suspend Client’s Services and/or terminate this agreement if Client is past due in paying RealtorLeads.net for Services requested. If this Agreement or any provisions of RealtorLeads.net’s products, services, and/or licenses are terminated for any reason, for example, by failing to pay Charges by the due date, RealtorLeads.net, in its sole discretion, may impose a reinstatement fee, in the amount of $100.

Cancellation, Termination, and Refund Policy

Client may terminate his/her account with RealtorLeads.net by providing notice to RealtorLeads.net at least five (5) business days prior to the end of the current billing period. All cancellation requests must be done by emailing RealtorLeads.net at contact@RealtorLeads.net. RealtorLeads.net will terminate services on the 1st day after the end of client’s then current billing period. It is Client’s responsibility to archive any information Client may be entitled to copy and reuse prior to deactivation. After Client’s services are deactivated, Client will not be able to access any information previously stored on and/or transmitted through the Services. RealtorLeads.net will not issue ANY refunds or ANY partial refunds. No refunds will be provided for setup fees, activation fees, service fees or any other paid fees for any reason.

Your Consent
By using our web site and participating on any specific offers and/or promotions, you (“User”) signify your agreement to this service agreement. This agreement represents the complete agreement and understanding between RealtorLeads.net and Client and supersedes any other written or oral agreement. At any time, RealtorLeads.net may modify these terms and conditions, amplify them, and/or modify the prices, as well as discontinue to change the services offered. Submission of your account order shall constitute your complete acceptance of this Service Agreement.
